TITLE
Recommendation to authorize City Manager to execute a quitclaim deed for a utility easement within the vacated portion of the east-west alley in the block west of Long Beach Boulevard and south of Third Street.  (District 2)
 
DISCUSSION
On January 23,2007, City Council adopted resolution no. RES-07-0009, vacating the east half of the east-west alley in the block west of Long Beach Boulevard and south of Third Street, reserving a utility easement over the alley portion vacated. The area vacated with a utility easement reservation is shown on the attached Exhibit A. The developer's plans were to remove the public utility facilities from the vacated alley during the construction process.
 
The City has now received notice from all of the interested utility departments and agencies that the public utility facilities have been removed, and it is appropriate at this time to quitclaim the reserved utility easement to the property owner. In conformance with the Environmental Quality Act, Mitigated Negative Declaration Number NO 08-05 was certified for this project. This letter was reviewed by Deputy City Attorney Linda Trang on May 16, 2008, and Budget Management Officer Victoria Bell on May 30,2008.
 
TIMING CONSIDERATIONS
City Council action on this matter is requested at the June 17, 2008, meeting in order to meet the developer's need to secure unencumbered title to this property.
 
FISCAL IMPACT
This quitclaim action is carried out as a part of the aforementioned vacation process, for which the developer paid a total fee of $4,000.00.
