TITLE
Recommendation to request City Attorney to prepare an amendment to Section 10.28.130 of the Long Beach Municipal Code to create Subzone "A" within Parking Meter Zone One. (District 3)

DISCUSSION
On February 9, 2010, the Long Beach City Council approved the purchase of an existing parking lot consisting of two parcels located at 189 Park Avenue. Escrow closed on March 8, 2010. Diamond Parking Company currently sets parking rates and provides enforcement on a month-to-month contract under an assignment to the City from the previous owner.

The City plans to purchase and install a multi-space parking meter for this lot. City Council approval is now being sought to create Subzone "A" within Parking Meter Zone One. The new subzone boundary will coincide with the boundaries of Los Angeles County Property Tax Assessor parcels 7256-022-020 and 7256-022-021.

This action requires an amendment to Section 10.28.130 of the Municipal Code, creating a separate subzone within Parking Meter Zone One. In order to set the parking meter rates, the City Council must hold a public hearing. This hearing will be noticed as required by law. Council will be asked to adopt a resolution setting the rates in the newly created Subzone "A". Rates would become enforceable on the effective date of the amendment to the ordinance.

This letter was reviewed by Deputy City Attorney Amy Burton on April 20, 2010, Budget and Performance Management Bureau Manager David Wodynski on April 22, 2010, and City Traffic Engineer David Roseman on April 19, 2010.

TIMING CONSIDERATIONS
City Council action is requested on May 18, 2010, to allow timely rate-setting and installation of parking meter equipment.

FISCAL IMPACT
There is no fiscal impact since the recommended change only establishes a parking meter subzone so that metering equipment may be installed. Parking meter rates will be approved separately.
