DISCUSSION
Controlled Environments Construction, Inc. (CEC), is the general contractor for a grading project located at 1710 Pier B.  As of January 7, 2014, CEC paid $29,157 to grade the land, demolish miscellaneous concrete pads and pits, and make site improvements for a cold storage building.  Inadvertently, CEC was charged for a building permit instead of a grading permit, which is calculated differently.  Development Services staff identified the discrepancy.  CEC is owed a refund of $10,572.  
 
In accordance with Long Beach Municipal Code Section 3.48.040, which requires that refunds exceeding $10,000 be approved by the City Attorney and City Council, an approval to process the refund is requested on behalf of the applicant.
 
This matter was reviewed by Deputy City Attorney Linda Vu on April 7, 2014 and by Budget Management Officer Victoria Bell on April 15, 2014.
 
TIMING CONSIDERATIONS
City Council action is requested on May 13, 2014, to expedite processing of the refund.
 
FISCAL IMPACT
The amount of $10,572 will be refunded from the Development Services Fund (EF 337) in the Development Services Department (DV).  No fiscal impact or local job impact is expected as a result of this recommended action.
 
SUGGESTED ACTION
Approve recommendation.
