TITLE
Recommendation to authorize City Manager to execute a First Amendment to Agreement No. 28249, with Concept Marine Associates (CMA), a Division of TranSystems Corporation (formally known as Concept Marine Associates), to extend the term to December 31, 2007, at no additional cost, for Construction Management Services for the rebuild of the Long Beach Shoreline and Rainbow Harbor Marinas (Marinas).  (District 2)
 
DISCUSSION
 
On March 25, 2003, the City Council approved a professional services agreement with CMA for Construction Management Services for the rebuild of the Marinas (Attachment #1). On March 23, 2004, City Council approved an agreement with Connolly-Pacific Company for the design-build of the Marinas, and actual construction began in February 2005.
 
At the time of the contract award to CMA, the construction timeframe was unknown.
Construction is now estimated to be completed by April 2007. A first amendment to the agreement is requested to extend the term of the agreement to December 31, 2007, to allow CMA to continue to provide general management and engineering services, including inspection, during the construction phase, and for completion of pertinent documents and drawings following construction.
 
This matter was reviewed by Deputy City Attorney J. Charles Parkin on January 9, 2006, and Budget Management Officer David Wodynski on January 11, 2006.
 
 
TIMING CONSIDERATIONS
City Council action is requested on January 24, 2006, to avoid interruption of the necessary services.
 
FISCAL IMPACT
The existing agreement with CMA is for an amount not to exceed $1,606,418. The funds are budgeted in Capital Project Number PW8340 in the Capital Projects Fund (CP) in the Department of Public Works (PW). No additional funds are required for this Amendment.
