DISCUSSION
The owner of Panama Joe's restaurant, located at 5100 East Second Street, requested a permit to temporarily occupy part of the adjoining sidewalk for the purpose of sidewalk dining. This restaurant's previous permit expired June 2001, and was never renewed. The proposed permit area and a list of furnishings and accessories to be placed in the permit area are shown on the attached Exhibit A. Approval of this permit is based on the conditions and standards of Chapter 14.14 of the Long Beach Municipal Code, which describes temporary uses of public rights-of-way. The width of the sidewalk at this location is 13.5 feet. A minimum clearance of 5 feet shall be maintained between the proposed permit area and the street tree adjacent to the restaurant. This permit request was reviewed and approved by the Long Beach Fire Department on July 11,2005. The subject permit was prepared by Deputy City Attorney Lisa Peskay Malmsten on August 8,2005.
