TITLE
Recommendation to authorize City Manager to execute a Public Walkways Occupancy Permit to the owners of the Promenade Lofts building for future restaurant sidewalk dining adjacent to 210 East 3rd Street, Suite D.  (District 2)
 
DISCUSSION
Lyon Promenade, LLC, the owner of the Promenade Lofts building located at 210 East 3rd Street, Suite D, has requested a permit to temporarily occupy a portion of the adjoining sidewalk to construct a sidewalk dining area for a future restaurant. A map of the proposed permit area is attached. The proposed permit area will consist of a barricade only; no furnishings will be placed within the permit area at this time.  
 
The street fixtures adjacent to the proposed permit area do not reduce the remaining public rights-of-way to less than the required 5-foot minimum clear passage. Approval of this permit is based on the conditions and standards of Chapter 14.14 of the Long Beach Municipal Code, which describes temporary uses of public rights-of-way.  
 
This permit request was reviewed and approved by the Long Beach Fire Department on December 18, 2012.  This matter was reviewed by Deputy City Attorney Linda Trang and by Budget Management Officer Victoria Bell on December 13, 2012.
 
TIMING CONSIDERATIONS
City Council action on this matter is requested on January 8, 2013, to accommodate the applicant's grand opening plans.
 
FISCAL IMPACT
A permit processing fee of $936 and a security deposit of $936 were deposited into the General Fund (GP) in the Department of Public Works (PW).  Approval of this recommendation will provide continued support to the local economy.
