TITLE
Recommendation to authorize City Attorney to pay the sum of $7,500 in full settlement of lawsuit entitled, Castro v. City of Long Beach, et al.

DISCUSSION
This case involves a motor vehicle accident wherein Plaintiffs, Castro (driver) and Limon (passenger) were driving westbound on PCH at about 30 mph in #1 lane. Officer King was driving an unmarked vehicle when he pulled from the curb making a U-turn in front of Plaintiffs' vehicle resulting in a collision.

Plaintiffs sought treatment from St. Mary's Hospital and chiropractic treatment for soft tissue injuries. Castro's medical specials were $13,890. Limon's medical specials were $3,610 along with lost earnings of $335.

After negotiations, the parties tentatively agreed to a full and complete settlement, inclusive of all costs and fees in the amount of $7,500.

The proposed settlement was presented to the Economic Development and Finance Committee on March 2, 2010 and was approved on that date. We therefore ask authority to pay the sum of $7,500 in full settlement of this claim against the City of Long Beach.
