TITLE
Recommendation to adopt resolution authorizing City Manager, or designee, to execute Local Programs Assistance Right-of-Way Certifications to Caltrans for selected, federally funded roadway construction projects. (Citywide)
DISCUSSION
In concert with the Federal Highway Administration, Caltrans has begun requiring the execution of full Right-of-Way Certification documents for all roadway projects using federal funds, even for projects not requiring the acquisition of additional Right-of-Way. In accordance with Caltrans current procedures, the Right-of-Way Certification must be executed by a responsible official given authority to so do by the governing board of the local agency submitting the Certification.
Council is being requested to authorize the City Manager, or his/her designee (e.g., the Director of Public Works, the City Engineer, or the Assistant City Engineer) to execute Right-of-Way certificates. City Council’s authorization to sign Right-of-way Certificates is requested only for roadway construction projects that do not require the acquisition of any additional Right-of-Way.
This matter was reviewed by Deputy City Attorney Linda Trang on July 5, 2012 and by Budget Management Officer Victoria Bell on July 3, 2012.
TIMING CONSIDERATIONS
City Council action on this matter is requested on July 24, 2012, in order to provide for the timely execution of documents required by Caltrans for approval of projects for federal funding.
FISCAL IMPACT
There is no fiscal impact as a result of the recommendation and no local job impact associated with the recommendation.
