TITLE
Recommendation to authorize City Manager, or designee, to execute all documents with the Orange County Transportation Authority (OCTA) necessary to relocate a segment of City-owned natural gas pipeline in connection with OCTA’s widening of the Seal Beach Boulevard Bridge and State Route 22 (SR 22). (Citywide)

DISCUSSION
The City of Long Beach owns a natural gas pipeline commonly known as Line 1228, which runs from Long Beach to Huntington Beach. Line 1228 is being leased to Southern California Gas Company, which operates and maintains Line 1228. Under the terms of the Line 1228 lease, the City is responsible for capital expenses associated with Line 1228. The Seal Beach Boulevard Bridge and SR 22 are being widened by aCTA to accommodate the expansion of the SR 22/405 Freeway. The widening of the Seal Beach Boulevard Bridge impacts a segment approximately 750 feet long of Line 1228. aCTA has requested that the City relocate this segment of Line 1228 by spring of 2010.

The City Attorney has determined that applicable statutes and case law require that the City pay necessary relocation costs in order to accommodate the widening of SR 22 and the bridge. Various administrative documents related to the relocation of the segment of Line 1228 are anticipated to require execution. The Long Beach Gas and Oil Department is currently working with the California Department of Transportation on obtaining encroachment permits, approval of the traffic control plan, and construction working hours.

This matter was reviewed by Deputy City Attorney Richard Anthony on November 9, 2009, and by Budget and Performance Management Bureau Manager David Wodynski on November 12, 2009.

TIMING CONSIDERATIONS
City Council action is requested on December 15, 2009, to authorize commencement of this project. The project must be completed by Spring 2010.
