TITLE
Recommendation to authorize City Manager to execute a Public Walkways Occupancy Permit for sidewalk dining at Michael's Pizzeria, located at 210 East 3rd Street, Suite C.  (District 2)
 
DISCUSSION
Michael's Pizzeria Promenade, LLC, the operator of the Michael's Pizzeria restaurant, has requested a permit to temporarily occupy a part of the adjoining sidewalk at 210 East 3rd Street, Suite C, with portable fixtures, for the purpose of sidewalk dining.  A map of the proposed permit area and a list of furnishings and accessories to be placed in the permit area is attached.
 
The street fixtures adjacent to the proposed permit area do not reduce the remaining public rights-of-way to less than the required 5-foot minimum clear path.  Approval of this permit is based on the conditions and standards of Chapter 14.14 of the Long Beach Municipal Code, which describes temporary uses of public rights-of-way.  
 
This permit request was reviewed and approved by the Long Beach Fire Department on December 19, 2012.  This matter was reviewed by Deputy City Attorney Linda Trang and by Budget Management Officer Victoria Bell on December 13, 2012.
 
TIMING CONSIDERATIONS
City Council action on this matter is requested on January 8, 2013, to accommodate the applicant's grand opening plans.
 
FISCAL IMPACT
A permit processing fee of $1,368 and a security deposit of $1,368 were deposited into the General Fund (GP) in the Department of Public Works (PW).  Approval of this recommendation will provide continued support to the local economy.

Approve recommendation.
