TITLE
Recommendation to respectfully request City Attorney to draft a resolution reiterating the Council's opposition to Proposition 8.
DISCUSSION
In 2008, the City Council moved to oppose Proposition 8, which at the time was on the ballot for the consideration of California voters. The Proposition denied the fundamental right of two people to marry.
The original agenda item, which was heard at the August 19, 2008 meeting of the full City Council noted:
"In a free society, two people in a committed, trusting and loving relationship expect the freedom to marry and the honor and support that come with marriage. We should not support any attempt to make their marriage illegal."
Proposition 8 eventually passed, but has been the subject of numerous legal challenges, and has voided thousands of marriages that took place all over the state.
On December 7th, the United States Supreme Court agreed to hear a challenge to Proposition 8, and will more than likely do so in the spring. It is appropriate at this time that the City express its opposition to Proposition 8 and its support of numerous challenges to the high court.
