TITLE
Recommendation to authorize City Attorney to pay the sum of $25,000 in full settlement of lawsuit entitled Burleigh Durrell Chester v City of Long Beach, et al., Case No. CV09-04543 VBF PJXx; and to pay sum of $8,000 in full settlement of lawsuit entitled George Pellin v City of Long Beach, et al., Claim No. C11-0134.
 
DISCUSSION
On June 11, 2008, Long Beach Police Officers arrested Plaintiff, Chester for taking a cup and ice from 7-Eleven store without permission of the store's manager. Chester spent approximately forty-five (45) days in jail before the Court dismissed his case. Chester now sues for excessive force and false arrest. Following a settlement conference held by the Court, Plaintiff agreed to accept $25,000.00 as a full, global settlement of this case, including attorneys' fees.  The settlement was approved by the Economic Development and Finance Committee on July 5, 2011.

On December 12, 2010, Long Beach police officers encountered a suspect at property located at 5333 Ocean Blvd. in Long Beach. The property is rental property owned by claimant George Pellin. Police damaged the property while seeking to detain and arrest the suspect. Following settlement discussions, the claimant has agreed to accept a total of $ 8,000.00 in full settlement of his claim. The settlement was approved by the Economic Development and Finance Committee on July 5, 2011.
