DISCUSSION
On November 8, 2011, the City Council authorized the City Manager to enter into a contract with Flatiron (Contract No. 32484) for CCTV Camera Systems and ATCS Integration on Atlantic Avenue. This project was for an estimated amount of $2,475,971, plus a 10 percent contingency of $247,597, for a total not to exceed contract amount of $2,723,568. Now that the project is under construction, unforeseen conditions have resulted in the need for additional work that will exceed of the contract amount. These conditions involve unforeseen underground utilities, repairs to the storm drain system, Americans with Disabilities Act (ADA) improvements and the replacement of deteriorating communications and electrical conduit.

The project is funded by a 2009 Metro Call for Projects (Metro) grant with matching funds from the Traffic Mitigation Program (TMP). There is sufficient budget in the project to support the contract increase.

This matter was reviewed by Deputy City Attorney Linda Vu on March 20, 2013 and by Budget Management Officer Victoria Bell on March 22, 2013.

TIMING CONSIDERATIONS
City Council action is requested on April 9, 2013, to ensure expeditious project delivery and reduce construction related disturbances to the public.

FISCAL IMPACT
The total contract amount will not exceed $2,888,568, funded by $1,617,598 in Metro grant and $1,270,970 in TMP. Sufficient Metro grant and TMP funds are appropriated in the Capital Projects Fund (CP) in the Department of Public Works (PW) to support the contract increase. Approval of ...
