DISCUSSION
On August 16, September 4 and September 18, 2007, Gary Gensemer paid for plan check, permit and development impact fees totaling the amount of $20,253 for the property located on 5115 Vista Street, project number 506289. The applicant has cancelled the project and no inspections have been made. Of the fees paid, $13,168 is eligible for a refund. Therefore, an approval to process a refund in the amount of $13, 168 for applicable fees is requested on behalf of the applicant.
 
The City of Long Beach Municipal Code, Section 3.48.040, requires that refunds exceeding $10,000 be approved by the City Attorney and City Council.
 
This matter was reviewed by Deputy City Attorney Richard Anthony on June 5, 2008 and by Budget Management Officer Victoria Bell on June 10, 2008.
 
TIMING CONSIDERATIONS
City Council action on this item is requested on July 8, 2008, to expedite processing of the refund.
 
FISCAL IMPACT
The refund amount of $13,168 will be refunded from the Development Services Fund (SR 137) where the collected fees were deposited.
 
SUGGESTED ACTION
