TITLE
Recommendation to authorize City Manager to execute a Public Walkways Occupancy Permit, with ground supported canopy, for sidewalk dining at The Federal Bar restaurant located at 102 Pine Avenue. (District 2)

DISCUSSION
The operator of The Federal Bar restaurant, located at 102 Pine Avenue, requests a permit to temporarily occupy part of the adjoining sidewalk for the purpose of sidewalk dining. The proposed permit area and the list of furnishings to be placed in the permit area, which includes a canopy constructed over the proposed permit area, are shown on the Exhibit A. The canopy structure meets the standards established by the Municipal Code Section 14.14.050, which provides for canopy structures on the public sidewalk. These structures must comply with all applicable Fire, Health and Building Code regulations. A photographic exhibit, showing the canopy in place, is attached as Exhibit B. The color of the canopy will be a medium-toned beige, to match the building, as required by the Municipal Code. Approval of the Public Walkways Occupancy Permit is based on the conditions and standards of Chapter 14.14 of the Long Beach Municipal Code, which describes temporary uses of public right-of-way. The width of the sidewalk at this location is 22 feet. A clear path along the sidewalk adjacent to the permit area will vary from 7 feet, 6 inches, between the street tree and curb, and 9 feet, 6 inches, between the barricade and curb, as shown on page 3 of Exhibit A.

This matter was reviewed by the Development Services Building and Safety Bureau on January 14, 2015, by Deputy City Attorney Linda Vu on September 17, 2015, and by Budget Management Officer Victoria Bell on October 6, 2015.
