TITLE
Recommendation to adopt Plans and Specifications No. R-6811 for the Mothers Beach restrooms; and award the contract to, and authorize City Manager to execute the contract with Spec Construction Company, Inc., in an estimated amount of $766,700, and any amendments thereto.  (District 3)
 
DISCUSSION
The men's and women's restrooms are part of the existing lifeguard station at Mothers Beach and are in need of refurbishment to improve security and utility in this popular destination for family groups at which a new playground was recently completed.
 
The work at Mothers Beach will consist of: conversion of the existing men's and women's restrooms to 10 individual stalls; expansion of the storage areas as a result of the building additions; and, addition of concrete paving, to provide access to the new facilities.  The new restrooms are designed to be fully accessible in accordance with the American Disabilities Act.  A vicinity map is attached.
 
City Council's adoption of the plans and specifications and award of the contract to the lowest responsible bidder are being recommended concurrently in order to expedite implementation of this project.  The project was advertised for bids on July 2, 2010, and bids were opened on July 30, 2010.  In addition to placing an advertisement for bids in the Long Beach Press Telegram, bid documents were made available through the City's weblink at, http://www.PlanetBids.com <http://www.planetbids.com/> in a continuing effort to increase participation of local businesses, Minority Business Enterprises (MBEs), Women Owned Business Enterprises (WBEs), and Disadvantaged Business Enterprises (DBEs).  Bid documents were also sent to several trade publications and plan rooms catering to these groups within the construction industry.
 
For this bid, 682 firms registered on the website were notified via automatic email notice including 42 located in Long Beach.  Thirty-one sets of bid documents were purchased by prospective bidders, and 11 bids were received.  Of those firms, one is a local business, four are MBE and one WBE.  There were no DBE registered firms that submitted bids.  Spec Construction Company, Inc., of San Dimas, California, has been determined to be the lowest responsible bidder.
 
This matter was reviewed by Deputy City Attorney Amy Burton on September 20, 2010 and by Budget Management Officer Victoria Bell on September 22, 2010.
 
SUSTAINABILITY
The project has been designed to maintain as much of the existing lifeguard building improvements as practical, which will not only preserve portions of the existing structure for reuse, but also reduce the amount of construction waste that would have otherwise been diverted to the landfill as a result of demolition. To reduce energy consumption, dormers will be installed to provide ventilation and lights will be on occupancy sensors in the new restroom stalls.  Paint to be used throughout the project will comply with current Volatile Organic Compound regulations.
 
TIMING CONSIDERATIONS
City Council action on this matter is requested on October 12, 2010, to authorize commencement of this capital improvement project.  Construction is projected to begin in November 2010 and should take approximately 225 calendar days.
 
FISCAL IMPACT
The contract award is for an estimated amount of $766,700.  Available project funding is $784,970 and is budgeted in the Tidelands Fund (TF 401) in the Department of Parks, Recreation and Marine (PR).  The balance between the award amount and the available funding is insufficient to cover the anticipated construction administration costs, submittal reviews by the project architect, overhead surcharge, permit fees, and other related project costs.  In order to insure the project will not exceed the available allocated funding, staff has met with the contractor and negotiated a reduced scope of work by eliminating interior fixtures, finishes and equipment in the storage area, and limiting the scope of new landscaping.  This action will reduce the project costs by $139,960.  Upon award of the contract, a change order will be executed to reduce the contract by this amount.  
 
This project will create an estimated eight full-time equivalent (FTE) jobs.
