DISCUSSION

City Council approval is requested to amend the terms of Contract No. 34577 with Bitech Construction Company, Inc., Contract No. 34571 with Exbon Development, Inc., Contract No. 34582 with Good-Men Roofing and Construction, Inc., Contract No. 34586 with Harry Joh Construction, Inc., Contract No. 34578 with Thomasville Construction, Inc., and Contract No. 34575 with Vincor Construction, Inc., to extend the term of the contracts for one-year to March 21, 2022, to continue providing Job Order Contracting (JOC) services while the City completes the procurement process for the new JOC agreements.

 

At its meeting on March 21, 2017, the City Council awarded contracts to eight firms for JOC services for one year, with the option to renew for two additional one-year periods.  On March 24, 2020, the City Council amended six of these contracts with a revised total aggregate amount not to exceed $12,000,000.

 

The current contracts will expire on March 21, 2021, and the City has exhausted all extensions permitted in the contracts. Extending the term for one-year or until the new JOC contracts are executed, will ensure the continuity of current project deliverables. While the procurement process for the next set of JOC services contracts is currently underway, the procurement process has been negatively impacted by the pandemic and the requested action will provide adequate time for staff to complete the procurement process without an interruption to services. The City is extending the existing contracts without adding additional money to the contracts, as the current authority is sufficient.

 

This matter was reviewed by Deputy City Attorney Erin Weesner-McKinley and Business Services Bureau Manager Tara Yeats on February 12, 2021, and by Budget Management Officer Rhutu Amin Gharib on February 23, 2021.

 

TIMING CONSIDERATIONS

City Council action is requested on March 16, 2021, to allow for uninterrupted continuation of JOC services.

 

FISCAL IMPACT

The requested amendments will extend the terms for the six contracts for an additional one-year period, through March 21, 2022 or when the new JOC contracts are executed, whichever comes first. No additional aggregate contact authority is requested for the JOC and there is no appropriation increase requested at this time. Any work not currently budgeted will only proceed at such time as appropriations have been approved by the City Council.  This recommendation has no staffing impact beyond the normal budgeted scope of duties and is consistent with existing City Council priorities.  Approval of this action would potentially have a positive impact on the local job market.
