TITLE
Recommendation to authorize City Manager to execute a permit with Debby McCormick, an individual doing business as McCormick Divers, for the use of Belmont Plaza Pool, for the purpose of training divers for national and international competitions and to conduct diving competitions for a term of three years, with one two-year renewal option at the discretion of the City Manager or his designee.  (District 3)
 
DISCUSSION
Olympic and World Games coach Glenn McCormick founded McCormick Divers (McCormick) in 1968, and the organization has operated out of Belmont Plaza Pool since its inception. Debby McCormick, President of McCormick, began coaching in 1976, and continues to operate the organization. Programs offered by McCormick include Novice, a beginning competitive dive program, and a Junior Olympic (JO) program for divers able to perform JO dives, as required by the US Diving and Amateur Athletic Union National Organizations. Each program is designed to offer opportunities for boys and girls to participate in grassroots competitions, as well as national events, such as the Amateur Athletic Union Junior Olympic Games. All participants are provided with instruction on all aspects of springboard and platform diving.
 
McCormick currently has 32 divers, who compete locally and internationally. At the August 2009 Dive San Diego 4th Annual JO and Novice Invitational, McCormick won the Team Championship Award, placing first in the following categories: Boys (age 9 and under) 3-meter novice dive, boys (age 12-13) 3-meter and 1-meter novice dive, boys (age 14-15) 3-meter and 1-meter dive, girls (age 9 and under) 3-meter and 1-meter novice dive, girls (age 10-11) 3-meter and 1-meter novice dive, girls (age 12-13) 1-meter novice dive, girls (age 14-15) 3-meter and 1-meter dive, and girls (age 16-18) 3meter and 1-meter dive. On July 15, 2009, two McCormick divers were selected for the 2009 Press-Telegram Dream Team. McCormick has a long tradition of producing excellent divers and many have been recipients of college scholarships. Monthly fees range from $120 for the Lesson Program, to $280 for the Olympic Program, and McCormick provides scholarships for disadvantaged youth. McCormick is an integral part of the City's aquatics programs.
 
The proposed permit contains the following major provisions:
 
·  Permitted Area: The diving well and dry board training area at Belmont Plaza Pool, as designated on Exhibit A.
 
·  Term: Three years, through August 31,2012.
 
·  Renewal Options: One, two-year renewal option, at the discretion of the City Manager or his designee.
 
·  Authorized Use: McCormick shall use the permitted area for the purpose of training divers for national and international competitions and to conduct diving competitions.
 
·  Use Fees: McCormick shall pay an hourly practice fee per swim lane, which shall be $10 during the first permit year, $12 during the second permit year, and $15 during the third permit year. Upon execution of the first renewal option, the practice fee shall be adjusted to $20 per hour.
 
·  Special Event Fee Waiver: In consideration of McCormick's contribution toward ensuring that youth and families have the opportunity to participate in productive social and economic activities, the City shall waive all concession fees and hourly special event facility use fees for up to three events per year. However, McCormick shall reimburse the City for all other required permits and fees, as well as staff and related costs for special events, such as diving meets.
 
·  Insurance: McCormick shall provide evidence of insurance as deemed sufficient by the City's Risk Manager.
 
This matter was reviewed by Deputy City Attorney Gary J. Anderson on September 15, 2009, and Budget and Performance Management Bureau Manager David Wodynski on September 17, 2009.
 
TIMING CONSIDERATIONS
City Council action is requested on October 6, 2009, in order to authorize the execution of the permit with McCormick Divers.
 
FISCAL IMPACT
Revenue in the estimated amount of $9,000 for FY 10 will be deposited in the Tidelands Fund (TF) in the Department of Parks, Recreation and Marine (PR). All other reimbursements for City costs associated with special events will be deposited in their respective funds.
