DISCUSSION
City Council approval is requested to enter into a two-year contract with John L. Hunter & Associates, Inc., for the development of a Watershed Management Program.  The National Pollutant Discharge Elimination (NPDES) Permit for the City of Long Beach Municipal Separate Storm Sewer System (MS4) was adopted on February 6, 2014, by the California Regional Water Quality Control Board and became effective on March 28, 2014.  As a requirement of the Permit, the Permittee is required to develop a Master Watershed Management Program (MWMP) for the entire City of Long Beach.  Authorization is requested to enter into an agreement with John L. Hunter & Associates for the development of Water Management Programs (WMPs) for the following areas:  Alamitos Bay, Shoreline Water Front, City Beaches/Outfalls/Pier to Breakwater (San Pedro Bay), and the Port of Long Beach.  The development of a WMP includes information, such as preparation of a storm water implementation plan, creation of a reasonable assurance analysis model, and preparation of an integrated compliance monitoring plan.  John L. Hunter & Associates will be responsible for integrating these WMPs into the MWMP for the remaining areas of the City.  
 
A Request for Proposals (RFP) was advertised in the Press-Telegram on June 26, 2014, and 5,173 potential bidders specializing in environmental consulting services were notified of the RFP opportunity.  Of those potential proposers, 71 downloaded the RFP document via our electronic bid system.  The RFP document was made available from the Purchasing Division, located on the seventh floor of City Hall and the Division's website at www.longbeach.gov/purchasing.  An RFP announcement was also included in the Purchasing Division's weekly update of Open Bid Opportunities, which is sent to 30 local, minority and women's business groups.  One proposal was received on July 15, 2014, which was not a Disadvantaged Business Enterprise (DBE), not a Minority-owned Business Enterprise (MBE), not a Women-owned Business Enterprise (WBE), not a Small Business Enterprise (SBE), and not a Long Beach business (Local).  
 
An evaluation committee reviewed the written proposal and evaluated the firm on the following criteria:  demonstration of competence, experience in performance of comparable engagements, expertise and availability of key personnel, financial stability, conformance with the terms of the RFP, and reasonableness of cost.  John L. Hunter & Associates, Inc., of Buena Park, CA (not a DBE, MBE, WBE, SBE or Local), was determined to have the expertise that will meet the City's needs.
 
Local Business Outreach
 
In an effort to align with our outreach goal, Long Beach businesses are encouraged to submit proposals for City contracts.  The Purchasing Division assists businesses with registering on the Bids Online database to download RFP specifications.  Through outreach, 546 Long Beach vendors were notified to submit proposals, of which two downloaded and none submitted a proposal.  The Purchasing Division is committed to continuing to perform outreach to local vendors to expand the bidder pool.
 
This matter was reviewed by Deputy City Attorney Amy Webber on September 8, 2014 and by Budget Management Officer Victoria Bell on September 19, 2014.
 
SUSTAINABILITY
 
Various Total Maximum Daly Loads (TMDLs) have been established for setting a maximum limit for a specific metals and bacteria that can be discharged into a water body without exceeding water quality standards and impairing beneficial uses.  Developing the Master WMP and implementation of the subsequent capital improvement projects will help to isolate and abate these pollutants, which will lead to improved water quality.
 
TIMING CONSIDERATIONS
City Council action to adopt Specifications No. RFP PW14-060 is requested on October 7, 2014, to ensure the City meets the new NPDES regulation deadlines to reduce the amount of pollutants and improve water quality in Long Beach.
 
FISCAL IMPACT
The contract authority is for a not to exceed amount of $604,490 for a two-year period. Pending formal approval by the Long Beach Board of Harbor Commissioners, the Harbor Department will agree to pay a maximum of $173,900 for work specifically limited to the Port of Long Beach watershed and the Harbor Toxics TMDL.  The remaining non-Harbor portion of the contract cost of $430,590 is appropriated in the Tidelands Operations Fund (TF 401) in the Public Works Department (PW).
 
Upon completion and approval of the Master Watershed Management Program (MWMP) in FY 15, the City's compliance monitoring costs for FY 16 to FY 18 are currently estimated at $300,000 per year.  Funding for the FY 16 to FY 18 costs will be considered as part of the annual budget preparation process.  The award of this contract will provide continued support to our local economy.
