DISCUSSION
Long Beach Swim Club (Beach Swim Club), a competitive swim training club, has been operating since the 1960s, and was part of the original Phillips 66 Beach Swim Club that won national championships in 1969, 1970, and 1971. Originally, Phillips 66 Beach Swim Club served several Southern California cities, with approximately 500 members.  However, over time, many of these satellite clubs dissolved or merged with other swim clubs. Beach Swim Club became the Long Beach club and continues to operate out of Belmont Plaza Pool. Beach Swim Club currently has 200 members, 90 percent of which are Long Beach residents. At a recent competition, members placed first in the following categories: 50-yard freestyle, 100-yard butterfly, 100-yard freestyle, 100-yard breaststroke, and 500-yard freestyle. Beach Swim Club has a long tradition of producing great swimmers and many of its members have been recipients of college scholarships.
 
Teresa Pascuzzo, Head Coach, holds a doctorate in biomechanics and incorporates her knowledge of the mechanics of tissues, joints, and human movement into the training program. Her training strategy incorporates dry land and stretching exercises, along with swimming drills. The program is designed to develop the athlete as a whole and works to establish total fitness, thus reducing injuries and developing stronger athletes.  Swimmers, age five and up, are welcome to join. Monthly fees range from $50 to $105, depending on the swimmer's level, and Beach Swim Club provides scholarships for disadvantaged youth. Beach Swim Club is an integral part of the City's aquatics programs.
 
The proposed permit contains the following major provisions:
 
·  Permitted Area: Use of Belmont Plaza Pool, as designated on Exhibit A.
 
·  Term: Three years, through August 31, 2012.
 
·  Renewal Options: One, two-year renewal option, at the discretion of the City Manager or his designee.
 
·  Authorized Use: Beach Swim Club shall use the permitted area for the purpose of training swimmers for national and international competitions and to conduct swimming competitions.
 
·  Use Fees: Beach Swim Club shall pay an hourly practice fee per swim lane, which shall be $10 during the first permit year, $12 during the second permit year, and $15 during the third permit year. Upon execution of the first renewal option, the practice fee shall be adjusted to $20 per hour.
 
·  Special Event Fee Waiver: In consideration of Beach Swim Club's contribution toward ensuring that youth and families have the opportunity to participate in productive social and economic activities, the City shall waive all concession fees and hourly special event facility use fees for up to three events per year.  However, Beach Swim Club shall reimburse the City for all other required permits and fees, as well as staff and related costs for special events.
 
·  Insurance: Beach Swim Club shall provide evidence of insurance as deemed sufficient by the City's Risk Manager.
 
This matter was reviewed by Deputy City Attorney Gary J. Anderson on September 15, 2009, and Budget and Performance Management Bureau Manager David Wodynski on September 17, 2009.
 
TIMING CONSIDERATIONS
City Council action is requested on October 6, 2009, in order to authorize the execution of the permit with Long Beach Swim Club.
 
FISCAL IMPACT
Revenue in the amount of $7,800 will be deposited in the Tidelands Fund (TF) in the Department of Parks, Recreation and Marine (PR). All other reimbursements for City costs associated with special events will be deposited in their respective funds.
