TITLE

Recommendation to authorize City Manager to execute the Second Amendment to Site License No. 29003 between the City of Long Beach and Prime Property Fund, LLC, successor in interest to Walton CWCA Garden Grove 62, LLC, for City-leased property at 7446-7472 Orangewood Avenue, Building A, Garden Grove, California, to house the flight tracking radar system for the Long Beach Airport.  (Citywide)

 

DISCUSSION

On August 24, 2004, the City Council authorized the execution of Site License No. 29003 (License) for leased property for the location and installation of a flight tracking radar system for the Long Beach Airport (Airport).  The system, also known as SkyTrak, captures accurate and consistent radar data and was part of an upgrade to the Airport Noise and Operations Monitoring System (ANOMS) to monitor compliance with the City’s Noise Compatibility Ordinance.

 

SkyTrak, consisting of two antennae, a receiver and a processor, is installed and positioned in Garden Grove near an existing Federal Aviation Administration (FAA) radar facility to provide optimum data coverage in order to process and display an aircraft’s operator, altitude, direction and air speed.  Utilized by staff to track and investigate noise events at the Airport, SkyTrak is also made available on the Airport’s website to allow residents to view real-time aircraft activity over their communities.  In addition to viewing activity, residents can utilize SkyTrak to register complaints online.

 

The Site License terminated on March 31, 2015, and continues on a month-to-month basis.  The Second Amendment to Site License No. 29003 has been negotiated, containing the following major terms and provisions:

 

                     Licensor:  Prime Property Fund, LLC, successor in interest to CAL West Industrial Properties, LLC, a California limited liability company.

                     Licensee:  City of Long Beach

                     Term:  The term of the Site License shall be extended for a period of one year and shall terminate on March 31, 2016.

                     Extension:  The City Manager shall have the option to exercise five (5) extension options of one year each, subject to availability of funds.

                     Rent:  The monthly base rent shall be $580 and shall increase up to three percent annually on April 1.

 

Under the terms of the Site License, the City may terminate the agreement, in the event the site is no longer suitable for its operations due to economic, environmental or technological reasons or problems with radar signal strength or interference.  All remaining terms and provisions shall remain in full force and effect.

 

This matter was reviewed by Deputy City Attorney Richard F. Anthony on June 23, 2015 and Budget Management Officer Victoria Bell on June 25, 2015.

 

TIMING CONSIDERATIONS

City Council action on this matter is requested on July 14, 2015, in order to execute the Second Amendment in a timely fashion for continued operation of the Airport’s flight tracking radar system.

 

FISCAL IMPACT

Annual rental payments of $6,960 are budgeted in the Airport Fund (EF 320) in the Airport Department (AP).  There is no impact to local jobs.
