TITLE
Recommendation to adopt Plans and Specifications No. R-6767 and award an as-needed contract to All American Asphalt, for the annual contract for street improvements in an amount not to exceed $12,000,000; and authorize City Manager to execute any amendments thereto with All American Asphalt. (Citywide)
DISCUSSION
This annual contract is available to a number of City Departments to provide for improvements to local and secondary streets and similar or related projects. The work includes street pavement, curbs and gutters, sidewalks, curb ramps, irrigation repairs and improvements, and taxiway repairs and improvements.
This is a procurement tool with no funds actually committed to the base contract. While Public Works will be responsible for the administrative control and monitoring of the contract, the contract is utilized by more than one department, and for various projects throughout the year, with no specific contract amount guaranteed to the contractor. The award amount for the annual contract is based on the following anticipated projects and funding:

The specifications allow for an extension of the contract for up to two additional oneyear terms. In the event that a renewal option is exercised, the City will provide advance notification to the contractor and require any price increase to be submitted to the City Engineer for approval at least 60 days prior to expiration of the contract. The City reserves the right to accept or reject any price increase or to cancel the contract.
City Council adoption of the plans and specifications and award of the contract to the lowest responsible bidder are being recommended concurrently to expedite project implementation. The project was advertised for bids on December 26, 2008, and bids were opened on January 16, 2009. Information regarding All American Asphalt is provided on the attached Contract Awards sheet.
This matter was reviewed by Deputy City Attorney Linda Trang on February 6, 2009 and by Budget Management Officer Victoria Bell on February 9, 2009.
TIMING CONSIDERATIONS
City Council action on this matter is requested on March 10, 2009, to allow for timely implementation of various capital projects.
FISCAL IMPACT
Due to the extensive use of this contract by various City Departments, the contract award is for an estimated amount of $12,000,000. Once revenue is received, individual purchase orders issued under this contract will be funded by the department issuing the purchase order within current appropriations; no appropriation increases are required.
