DISCUSSION
The City recently conducted a pilot program to saw cut and remove the elevated edge of displaced concrete sidewalk panels in lieu of temporary asphalt patches typically installed by City Crews.  The pilot program, conducted in Council District 5, was performed by Suncal Precision Concrete, Inc. ("SPC") using a patented system.   Instead of a "grinding" process, they have developed a horizontal saw cutting system that is fully compliant with the Americans with Disabilities Act requirements.  The process allows cuts to be tapered at a 1:8 slope and is unique in its capability to make cuts at any angle and to remove the concrete completely at all edges of the walk (competitors are unable to cut against fences or other obstacles, leaving potential liability hazards).  This system is also unique in its ability to do all saw cutting to the zero point of differential settlement and to leave a much smoother, uniform appearance and texture.
 
Following the pilot program, a blanket purchase order was issued to SPC for $85,000 to perform additional work in Council Districts 3, 5, and 8 but is now exhausted due to the program's popularity.  Attached for City Council's consideration is a resolution authorizing the City Manager to forego the bidding process and to authorize the City Manager to enter into a contract with SPC for an amount not to exceed $200,000 allowing for an extension of the current pilot program.  To ensure the City benefits from the best pricing for the services provided, staff will conduct a competitive bid process to replace this interim contract later this year.  
 
This matter was reviewed by Deputy City Attorney Lori A. Conway on December 26, 2007, and by Budget Management Officer Victoria Bell on December 26, 2007.
 
 
TIMING CONSIDERATIONS
Because staff anticipates that work orders will be issued starting February 2008.  City Council action on this matter is requested on January 8, 2008 to continue the current pilot program until a more formal contract can be bid later this year.
 
FISCAL IMPACT
The contract award is for an estimated amount of $200,000. Sufficient funds to cover the contract are budgeted in Capital Improvement Project PW5250 in the General Capital Projects Fund (CP) in the Department of Public Works (PW).  No appropriation increase is required.
