TITLE

Recommendation to authorize City Manager, or designee, to execute a cooperative agreement and any related documents for the Law Enforcement Officer Reimbursement Program, and any subsequent amendments, with the U.S. Transportation Security Administration to provide qualified law enforcement services on-site at the Long Beach Airport passenger screening checkpoint; and to accept the anticipated award in an estimated amount of $814,555, for a three year period.  (District 5)

 

DISCUSSION

Since November 19, 2001, the Transportation Security Administration (TSA) has the authority to carry out Chapter 449 of Title 49 United States Code relating to civil aviation security, including responsibility for screening passengers and property at airports, and for mandating the deployment of Law Enforcement Officer (LEO) personnel at each airport security passenger-screening location to ensure passenger safety and counter risks to transportation security. 

 

On August 21, 2007, City Council authorized the City Manager to enter into a Cooperative Agreement with the TSA to receive partial reimbursement for the two LEO personnel provided by Long Beach Airport (Airport) for the security passenger-screening checkpoints.  The two checkpoints were staffed for 16.5 hours per day, from 5:30 a.m. to 10:00 p.m. daily.  The performance period for the agreement began October 1, 2007, and expired September 30, 2012.  

 

TSA renewed the program in 2012, and entered into a new agreement that began October 1, 2013, and expires January 31, 2016 with the City. The amount awarded was lower than the previous agreement because only one LEO position is required for the new consolidated TSA screening and checkpoint facility.

 

To continue the LEO Reimbursement Program and prevent any lapse in funding, the Airport submitted a new application on August 8, 2015 for funding in an estimated amount of $814,555 for a period of February 1, 2016 through December 31, 2018. City Council approval is requested in advance of the award to facilitate the TSA timeline for execution of the agreement. An award is anticipated by the time this letter is before the City Council.

 

This matter was reviewed by Deputy City Attorney Richard Anthony on November 9, 2015, and by Budget Operations Administrator on November 12, 2015.

 

TIMING CONSIDERATIONS

City Council action on this item is requested on January 5, 2016, in advance of the award, to ensure that the agreement is filed and processed within the time period required by the TSA.  Failure to meet this deadline may result in loss of funding. 

 

FISCAL IMPACT

The implementation of the LEO Reimbursement Program Cooperative Agreement will provide reimbursement of LEO costs for an estimated funding of $814,555 in the Airport Fund (EF 320) in the Airport Department (AP) for the period of February 1, 2016 through December 31, 2018.  No match is required to participate in the program.  Since the agreement amount is not yet awarded, any appropriation increase will be included in a subsequent budget adjustment request to City Council. There is no local job impact associated with this recommendation.
