DISCUSSION
On August 19, 2003, the City Council authorized the City Manager to execute a twoyear
right of entry permit with the Los Angeles and San Gabriel Rivers Watershed
Council (Watershed Council) for use of City property for a research program
(Attachment A). The program focus was to evaluate the benefits of storm water
infiltration for enhancing environmental health, increasing urban green space,
conserving water, providing jobs and increasing our local water supply. El Dorado Park
and Veterans Park served as the selected program sites for collecting soil samples and
testing. The program findings concluded that Veterans Park would be the best location
for the construction of subsurface monitoring equipment to collect and percolate storm
runoff. Monitoring equipment was established at the site and the Watershed Council
continued collection and testing during the term of the permit.
The Watershed Council requested another right of entry permit to continue their
monitoring efforts. The Department of Parks, Recreation and Marine Planning and
Development Bureau and the Department of Public Works Storm Water Management
Division have maintained communications with the Watershed Council and support the
request. The right of entry permit will include the following major terms and conditions:
Location: Veterans Park community center lawn and parking lot located at 101 E.
28'h Street.
Term: Two years, with two (2) one-year options to renew at the sole discretion of
the City Manager. . Size: The footprint of the monitoring equipment is an approximate 12-inch steel
cover (for each well), flush with the surface
Use: The Watershed Council will collect and test samples from the subsurface
monitoring equipment after each storm. The findings will be shared with the City of
Long Beach Department of Public Works Storm Water Management Division.
Maintenance: The Watershed Council will be responsible for cleaning and
maintaining the infiltration structure installed beneath the lawn. The City will be
responsible for cleaning the catch basin inlets, as necessary.
Equipment Removal: At the conclusion of the project, the City may require removal
of the monitoring equipment by the Watershed Council.
Insurance: The Watershed Council shall provide evidence of insurance, as required,
by the City's Risk Manager.
Indemnitv: The Watershed Council will indemnify the City against any damage
caused by its use of the site.
Permit Fee: In lieu of a permit fee, the Watershed Council will provide the results of
the study to the City, at no charge, for the City's future use.
