DISCUSSION
City Council approval is requested to enter into an annual contract with Moine Brothers for the removal of eight underground storage tanks (two tanks per site) located at site 10, 1417 Peterson Avenue; site 37,2760 Studebaker Road; site 43, 1725 San Francisco Street; and site 65, 6204 E. 2nd Street, in an effort to bring each of these sites into compliance. The Department of Public Works, Fleet Services Bureau faces the challenge of maintaining all underground storage tanks (UST) and bringing them in compliance under Title 23 of the California Code of Regulations. In order to maintain the various UST sites within the City's boundaries, it was determined that these eight UST need to be removed.
 
The bid was advertised on November 1, 2007, and 48 potential bidders specializing in UST removal were notified of the bid opportunity; five are Minority-owned Business Enterprises (MBEs), ten are Women-owned Business Enterprises (WBEs), six are Long Beach businesses, and 13 are certified Small Business Enterprises (SBEs). The bid document was made available from the Purchasing Division, located on the Plaza Level of City Hall, and the Division's website at www.lonqbeach.qov/purchasing. A bid announcement was also included in the Purchasing Division's weekly update of Open Bid Opportunities, which is sent to 30 local, minority and women's business groups. Bids were opened on December 6, 2007. Moine Brothers, of Wilmington, CA (not a MBE, WBE, local or SBE), is the lowest responsible bidder.

TIMING CONSIDERATIONS
City Council action to adopt Specifications No. PA-00308 and award a contract concurrently is requested on January 22, 2008 to ensure compliance with the State of California Water Resource Control Board, South Coast Air Quality Management District and County of Los Angeles Certified Unified Program Agency.
 
FISCAL IMPACT
The estimated cost of this contract is $150,000. Funding for sites 10, 37 and 43 is budgeted in the Fleet Services Fund (IS 386) in the Department of Public Works (PW).  Site 65 will be fully funded by the Tidelands Operating Fund (TF) in the Department of Parks, Recreation and Marine (PR) with the requested appropriations increase of $68,164.  The City will have the option of adding expenditures up to 25 percent (or $37,500) above the contract amount.
