TITLE
Recommendation to authorize City Manager to execute a permit with Rod Edmondson, an individual doing business as OC Fitness Boot Camp, to use open space within City parks for group exercise classes and personal training for a term of two years, with three, one-year renewal options at the discretion of the City Manager or his designee.  (Districts 2,3,5)
 
DISCUSSION
On November 22, 2011, Rod Edmondson, an individual doing business as OC Fitness Boot Camp (OCFBC), submitted a proposal to the Department of Parks, Recreation and Marine (PRM) requesting the use of open space at El Dorado Park West and Bluff Park for the provision and operation of an outdoor group fitness program.  OCFBC was established by Rod Edmondson in 2004, and specializes in outdoor functional training for people looking to get into shape and improve their health.  
 
OCFBC classes will initially consist of four, one-hour classes per site, per week.  Personal training will consist of groups of one to two people per session, while small group exercise classes will consist of two to ten people per class.  Classes/sessions will include circuit training, team games, weight training, yoga, and nutrition counseling.  OCFBC will be responsible for ensuring that any items brought and used pursuant to its permitted use are removed promptly at the conclusion of each class.
 
This proposal is consistent with other PRM permits for this type of use, and helps address the growing demand for outdoor fitness within City parks and beaches.  Approval of permits within City parks rests with the Parks and Recreation Commission, which approved the portion of the proposal relative to the use of open space in El Dorado Park West on December 8, 2011.  However, as Bluff Park is within the Tidelands area, where permitting authority does not rest with the Parks and Recreation Commission, this permit requires approval from the City Council.
 
The proposed permit contains the following major provisions:
 
·      Term:  November 1, 2011 through October 31, 2013, with three, one-year renewal options at the discretion of the City Manager or his designee.
 
·      Permitted Use:  The provision and operation of group fitness classes within City parks during posted use hours, and/or use of open space prior to posted use hours, while adhering to noise and impact abatement conditions consistent with the Long Beach Municipal Code and PRM's Good Neighbor Policy.
 
·      Permit Areas:  El Dorado Park West and Bluff Park.  OCFBC may request use of additional City parks and/or beach sites.  Each additional site shall be subject to review and approval, and will be at the discretion of the City Manager or his designee.
 
·      Permit Fee:  OCFBC shall pay PRM an annual permit fee of $600 for the use of El Dorado Park West and Bluff Park.  Additional approved sites shall increase the annual permit fee by $300 per site, per year.
 
·      Insurance/Program Liability:  OCFBC shall provide proof of insurance coverage and a copy of its participant liability waiver, as defined and/or accepted to sufficiency by the City's Risk Manager, on an annual basis or upon policy renewal and/or change.
 
This matter was reviewed by Deputy City Attorney Gary J. Anderson on December 28, 2011, and Budget Management Officer Victoria Bell on December 30, 2011.
 
TIMING CONSIDERATIONS
City Council action is requested on February 7, 2012, in order to enable the execution of the permit.
 
FISCAL IMPACT
Annual revenue in the amount of $300 from the use of Bluff Park will accrue to the Tidelands Operations Fund (TF 401) in the Department of Parks, Recreation and Marine (PR).  Annual revenue in the amount of $300 from the use of El Dorado Park West will accrue to the General Fund (GP) in the Department of Parks, Recreation and Marine (PR).  If additional sites are approved by the City Manager or his designee, annual revenue will increase by $300 per site, per year, to either the Tidelands Operations Fund (TF 401) or the General Fund (GP) in the Department of Parks, Recreation and Marine (PR), depending on the location requested.  The recommended action will result in a positive impact on jobs.  If the proposed permit is approved, several personal training instructor jobs will be created in Long Beach, although the exact number is unknown at this time.
