DISCUSSION

City Council approval is requested to amend the Contract Nos. 34486, 34487, 34489, 34490, 34492, and 34493, for as-needed construction materials testing and inspection services, to extend the term of the contracts to December 31, 2023.

 

On December 20, 2016, the City Council adopted Specifications No. RFQ PW16-138 and awarded contracts to six selected consultants, in a total aggregate amount of $36,000,000, for a term of three years, with the option to renew for two additional one-year periods. These firms provide as-needed consultant services for current and anticipated projects within various City of Long Beach (City) Departments, including Public Works, Development Services, Long Beach Airport, Energy Resources, Parks, Recreation and Marine, and Water.

 

On August 3, 2021, the City Council approved a one-year extension to December 31, 2022 for the six contracts, for the total aggregate amount of $36,000,000.

 

The current contracts expire on December 31, 2022, and City has exhausted all permitted contract extensions. The procurement process for on-call construction materials testing and inspection services  is underway and City staff aim to complete the process by September 30, 2023. The Request for Qualification (RFQ) process involves Planning, Drafting and Opening of the RFQ, and Evaluation/Award and City Council approval and contract execution where each of these phases is anticipated to take 30 - 90 days, dependent upon staff capacity and availability. Extending the term an additional year will ensure the continuity of contracted deliverables and avoid potential service interruptions in the case of unforeseen delays with the procurement process.

 

This matter was reviewed by Deputy City Attorney Vanessa S. Ibarra and Budget Management Officer Nader Kaamoush on September 26, 2022, and by Purchasing Agent Michelle Wilson on September 15, 2022,.

 

TIMING CONSIDERATIONS

City Council action is requested on October 11, 2022, to ensure there are no interruptions to services.

 

FISCAL IMPACT

The requested action extends the contract terms to December 31, 2023. The aggregate contract authority for as-needed construction materials testing and inspection services will remain at the current amount not to exceed $36,000,000. Expenditures during the extended one-year term cannot be projected; therefore, no additional appropriation increase is requested at this time. Any work not currently budgeted will only proceed at such time as appropriations have been approved by the City Council. This recommendation has no staffing impact beyond the normal budgeted scope of duties and is consistent with existing City Council priorities. All six consultants mentioned are Minority-owned Business Enterprises (MBEs) or Small Business Enterprises (SBE), and two are also Long Beach businesses (Local). All six consultants have committed to using small, local, or disadvantaged firms as subconsultants on their teams, as appropriate, based on the work assigned to them by the City under these contracts. Approval of this action would potentially have a positive impact on the local job market.
