DISCUSSION
For more than ten years, Ken Williams, d.b.a. California Aquatics, has operated a kayak rental concession at Marina Park (San Marco and Appian Way) and Bay Shore Walk (Ocean Blvd. and 54'h Place). The current permit will expire on
May 31, 2006.  
 
In addition to his kayak rental concession, Mr. Williams provides free kayak instruction at 44 schools throughout Southern California as part of their Physical Education curriculum, including the Long Beach Unified School District. Through this instructional program, Mr. Williams promotes Long Beach as an aquatics destination to visitors.
 
A new permit has been negotiated with Ken Williams and the proposed terms and conditions are as follows:
 
- Permit Area: Bay Shore Walk (Ocean Blvd. at 54'h Place) and Marina Park (San Marco at Appian Way).
 
- Permitted Use: Operation of an aquatic equipment rental concession.
 
- Permit Fee: 15 percent of gross receipts or annual minimum rent of $8,500, whichever is greater.
 
- Term: Five-year term expiring May 31 , 201 1, with two, five-year options to renew at the sole discretion of the City Manager or his designee.
 
- Term: Five-year term expiring May 31, 201 I, with two, five-year options to renew at the sole discretion of the City Manager or his designee.
 
- Utilities: Permittee shall be responsible for all utility payments.
 
- Maintenance: Permittee shall be responsible for maintenance of the permit area.
 
- Insurance: Permittee shall provide insurance coverage as defined by the City's Risk Management Office.

TIMING CONSIDERATIONS
City Council action is requested on May 23, 2006, to enable the execution of the permit.
 
FISCAL IMPACT
All revenues associated with the permit, estimated at a minimum of $8,500, will accrue to the Tidelands Operating Fund (TF) in the Department of Parks, Recreation and Marine (PR).
