DISCUSSION
City Council approval is requested to enter into a contract with the Earl Corporation for the installation and with Myrtha Pools USA for the purchase of the Belmont Temporary Outdoor Pool.
 
In January 2013, the City's Belmont Pool Natatorium was closed due to a structural and seismic evaluation that concluded the facility was seismically unsafe in the event of a moderate earthquake. On February 12, 2013, the City Council authorized the City Manager to proceed with the entitlement phase of a permanent pool revitalization project, and proceed with the installation of a temporary outdoor pool to meet the needs of the City's aquatic community during the reconstruction of the new permanent pool. Additionally, City Council directed staff to expedite the design, procurement and construction of the temporary outdoor pool with incentives for early completion. The Invitation to Bid specifications included a timeline for completion by October 31, 2013.
 
The temporary outdoor pool will be constructed in the parking area east of the existing pool building and will be 53 by 25 meters in dimension, with a depth varying from 1.2 to 2 meters. Design features of the temporary outdoor pool will provide flexibility for a variety of users and events. Restroom and shower facilities and staff offices in the existing pool building will be utilized until the building is demolished, at which point separate temporary modular trailers will be brought onto the site to provide the code-required toilets and shower facilities, as well as staff office space.
 
This bid was advertised in the Press Telegram on July 5, 2013, and 2,753 potential bidders specializing in construction services were notified of the bid opportunity. Of those bidders, 70 downloaded the bid via our electronic bid system. The bid document was made available from the Purchasing Division, located on the seventh floor of City Hall, the Division's website at www.longbeach.gov/purchasing, and by being purchased through the Department of Public Works located on the tenth floor of City Hall. A bid announcement was also included in the Purchasing Division's weekly update of Open Bid Opportunities, which is sent to 30 local, minority and women-owned business groups. Six bids were received on July 25, 2013. Of those six bidders, one was a Minority-owned Business Enterprise (MBE), one was a Womenowned Business Enterprise (WBE), three were certified Small Business Enterprises (SBEs), and none were Long Beach businesses (Local). The Earl Corporation, of Irwindale, CA, an SBE (not an MBE, WBE or Local) was the lowest responsible bidder for the installation for the temporary outdoor pool, and Myrtha Pools USA, of Sarasota, FL (not an MBE, WBE, SBE or Local), was the lowest responsible bidder for the purchase of the temporary outdoor pool.
 
Local Business Outreach
 
In an effort to align with our outreach goal, Long Beach businesses were encouraged to submit bids for City contracts. The Purchasing Division also assisted businesses with registering on the Bids Online database to download the bid specifications. Through outreach, 281 Long Beach vendors were notified to submit bids, of which six downloaded and none submitted a bid. The Purchasing Division is committed to continuing to perform outreach to local vendors to expand the bidder pool.
 
The temporary outdoor pool was issued a Local Coastal Development Permit on April 8, 2013. All procedural CEQA requirements for this project have been met and a Notice of Exemption was filed on February 21,2013.
 
This matter was reviewed by Deputy City Attorney Linda Vu on July 31, 2013 and by Budget Management Officer Victoria Bell on July 31,2013.
 
TIMING CONSIDERATIONS
City Council action to adopt Plans and Specifications No. R-6962 and award a contract concurrently is requested on August 6, 2013 to ensure that the contract is in place expeditiously.
 
FISCAL IMPACT
The cost of these contracts, in a combined total amount not to exceed $5,150,614, is budgeted in the Tidelands Operations Fund (TF 401) in the City Manager Department (CM), through an appropriation in the FY 13 CIP program. There is no local job impact associated with this request.
