TITLE
Recommendation to authorize City Manager to execute all necessary documents to receive and expend grant funding from:  1) the Recovery Act: Edward Byrne Memorial Justice Assistance Grant Formula Program, and 2) the Edward Byrne Memorial Justice Assistance Grant Program FY 2009; and increase appropriations in the General Grants Fund (SR) and in the Police Department (PD) by $1,832,167.  (Citywide)
 
DISCUSSION
The City of Long Beach was recently allocated grant funding from the Department of Justice, Bureau of Justice Assistance for the Recovery Act: Edward Byrne Memorial Justice Assistance Grant (ARRA JAG) Formula in the amount of $1,627,573. The Department of Justice has designated 79 jurisdictions within the County of Los Angeles as disparate jurisdictions with a requirement to submit a joint application. The City of Los Angeles, acting as fiscal agent for all jurisdictions, requires ten percent for administration costs, with the City of Long Beach to receive a final award of $1,464,816. The grant monies will be used for front line law enforcement to fund roughly 17,000 hours of additional police presence in high crime areas and to purchase 145 mobile car radios, which will improve communications reliability, enhance officer safety and help ensure interoperability with regional partners.
 
Additionally, the City of Long Beach was recently allocated grant funding for the fifth year from the Department of Justice, Bureau of Justice Assistance for the Edward Byrne Memorial Justice Assistance Grant (JAG 09) Program FY 2009 Local Solicitation in the amount of $395,001. The Department of Justice has designated 60 jurisdictions within the County of Los Angeles as disparate jurisdictions with a requirement to submit a joint application. The City of Los Angeles, acting as fiscal agent for all jurisdictions, requires seven percent for administration costs, with the City of Long Beach to receive a final award of $367,351. The grant monies will be used for front line law enforcement to provide overtime, training, and to support a specially trained and selected Deputy Probation Officer (DPO) assigned by the County of Los Angeles to provide enhanced probation services to the City of Long Beach. The anticipated contract amount for the DPO is $129,612, plus any adjustments to salary, employee benefits, and/or overhead rates approved by the Board of Supervisors during the fiscal year, which is not expected to exceed $140,000.

TIMING CONSIDERATIONS
City Council action on this matter is needed on June 23, 2009, to meet a July 1 2009 deadline to submit a funding agreement to the City of Los Angeles and to expedite use of the grant funds upon final award notification.
 
FISCAL IMPACT
The JAG grants are currently unbudgeted; therefore, an appropriation increase is included in the recommendation. The expense appropriation will be fully offset by grant revenues and the grants do not require matching funds. Should the grant funds be insufficient to support the DPO position for the full term of the contract with the Los Angeles County Department of Probation, the City will not be held responsible for any costs in excess of the grant revenues.
