Recommendation to authorize City Manager to execute all necessary agreements and documents with the State of California (State), the Boeing company (Boeing), Caltrans, the County of Los Angeles (County), the City of Los Angeles (Los Angeles), the City of Lakewood (Lakewood), the City of Signal Hill (Signal Hill), and the City of Bellflower (Bellflower) for the funding, implementation, and operation of the Douglas Park Adaptive Traffic Control System (ATCS) in accordance with the Douglas Park Development Agreement (DPDA); and increase appropriations in the Transportation Fund (SR 182) in the Department of Public Works (PW) by $3 Million.  (Districts 4,5,6,7,8,9)
 
DISCUSSION
The DPDA between Boeing and the City of Long Beach (City) outlines a cooperative effort for the development, funding, and implementation of an ATCS to span a four-city area containing over 120 signalized intersections along eight major traffic corridors.
This new multi-agency adaptive traffic control system will provide seamless traffic management capabilities across jurisdictional boundaries and will be the first of its kind in the nation.
 
To implement this requirement under the DPDA, the City and Boeing have been working with Caltrans, the County, Lakewood, Signal Hill and Bellflower, to select an adaptive traffic signal control software system, design a regional communications system, review technical system design plans, and agree to various traffic signal control and operational parameters. The A TCS software selected by the partnering agencies to be deployed for the Douglas Park Project will be a modified version of software developed by traffic engineers from the Los Angeles Department of Transportation. In order to obtain the software and make modifications to Los Angeles' software specific to the City, new software licensing and maintenance agreements will need to be executed with Los Angeles. In addition, modifications to existing interagency agreements related to traffic signal operations and maintenance will also be necessary to clearly define operational roles and responsibilities related to the A TCS, communications facilities, data sharing, and traffic signal control parameters among each of the agencies.
 
In accordance with Section 8.28 of the DPDA, the City and Boeing jointly pursued State grant funds for the implementation of the Douglas Park A TCS project. In June of 2008, the State notified the City that the application for these funds has resulted in an award of $3 million in State Traffic Light Synchronization Program (STLSP) funds specifically identified for the implementation of the Douglas Park ATCS. As the sponsoring agency, the City would administer the grant funds and Boeing would construct the improvements. In order to accept these grant funds and ensure that Boeing will comply with all applicable State contracting practice requirements, the City will have to enter into separate agreements with both Caltrans and Boeing for the receipt and administration of the grant funds.
 
This matter was reviewed by Deputy City Attorney Linda Trang on July 31,2008 and by Budget Management Officer Victoria Bellon August 4, 2008.
 
TIMING CONSIDERATIONS
City Council action on this item is requested on August 19, 2008 in order to authorize the City Manager to execute all necessary documents for the receipt of $3 million in State STLSP funds for the Douglas Park A TCS project, which are due back to the State by August 22, 2008.
 
FISCAL IMPACT
This request will increase appropriations in the Transportation Fund (SR 182) in the Department of Public Works by $3 million in order to receive the grant funds and disburse them. There is no anticipated cost to the City, as the total cost of the planning, design, and implementation of the Douglas Park A TCS project will be borne by Boeing and will be reimbursed from grant funds.
