TITLE
Recommendation to authorize City Manager to execute the First Amendment to Contract No. 29182 with TruGreen Landcare, a California General Partnership, increasing the second year amount to $1,000,000 to furnish and deliver tree trimming services.  (Citywide)
 
DISCUSSION
On March 1, 2005, the City Council awarded a contract to furnish and deliver tree trimming services to TruGreen Landcare, a California General Partnership, in the amount of $800,000, with two additional one-year terms (see Attachment). For over a decade, private contractors have been utilized to complement City forces to trim street trees within the public rights-of-way. Through the contract, timely maintenance is performed, thereby preserving and protecting the urban forest by reducing the number of trees damaged or destroyed by overgrowth and inclement weather. Complementing the Public Works tree trimming operation with contracted services has proven to be an effective means of providing this service to the public.
 
The contractor has made excellent progress and will complete all previously assigned tree trimming ahead of schedule. Based on an early completion date and the contractor's performance, staff is requesting a contract amendment to increase the contract amount by $1,000,000, bringing the total contract amount for two years to $1,800,000. The contractor has agreed to continue street tree trimming work at a marginal 4.5 percent increase above the unit prices at the time of award. The Contractor has provided two new unit prices which will provide for stump grinding service and park tree trimming.
 
This matter was reviewed by Senior Deputy City Attorney Donna F. Gwin on March 8, 2006, and Budget Management Officer David Wodynski on March 9, 2006.
 
TIMING CONSIDERATIONS
City Council. action on this matter is requested on March 21,2006, to maintain continuity with the City's tree trimming cycles.
 
FISCAL IMPACT
Due to the use of this contract by various City Departments, the contract amendment is for the amount of $1,000,000. Individual purchase orders issued under this contract will be funded by the department issuing the purchase order within current appropriations;
no appropriation increases are required.

Approve recommendation.
