TITLE

Recommendation to authorize City Manager, or designee, to execute a Memorandum of Understanding, and all necessary documents including any subsequent amendments, with the United States Secret Service, to participate in, and receive reimbursement for participation in the Cyber Fraud Task Force (CFTF).  (Citywide)

 

DISCUSSION

City Council approval is requested for the Long Beach Police Department (LBPD) to enter into a Memorandum of Understanding (MOU) with the United States Secret Service (USSS), to participate in the Cyber Fraud Task Force (CFTF) and receive reimbursement of overtime and other pre-approved expenses, including but not limited to travel, fuel, training, and equipment, incurred by the LBPD in providing resources to assist in joint law enforcement operations.

 

The USSS has seven Regional Cyber Centers in the country and LBPD will participate in the Los Angeles Cyber Fraud Task Force.  Domestic task forces are staffed with special agents, technical experts, forensic and cyber analysts, and National Computer Forensic Institute trained task force officers.  LBPD will have access to free training on computer forensics, cryptocurrency, skimmers and other financial related equipment and tactics.

 

This matter was reviewed by Deputy City Attorney Arturo D. Sanchez on October 11, 2022 and by Budget Management Officer Nader Kaamoush on October 13, 2022.

TIMING CONSIDERATIONS

City Council action is requested on November 1, 2022, to ensure the MOU is in place expeditiously.

 

FISCAL IMPACT

Participation in Cyber Fraud Task Force is beneficial to impacting electronic crimes. This MOU formalizes the relationship with the regional cyber centers for these activities. Reimbursement of costs is not guaranteed and therefore is not used to determine participation in task force operations. Participation in the task force is based on LBPD staffing, available budget, and operational needs, as determined by the Chief of Police. When available and pursuant to the Treasury Executive Office for Asset Forfeiture (TEOAF), reimbursement of costs will not exceed $15,000 to one law enforcement official per fiscal year. Any reimbursement received will be deposited in the General Fund Group in LBPD. This recommendation has no staffing impact beyond the normal budgeted scope of duties and is consistent with existing City Council priorities. There is no local job impact associated with this recommendation.
