TITLE
Recommendation to authorize City Manager to execute all documents necessary for a lease with Raquel Martinez, an individual, for approximately 414 square feet of commercial office space at 2132 East Fourth Street, for use as the City Council Second District Field Office, for a two-year term at the initial monthly base rent of $925.  (District 2)
 
DISCUSSION
Since the late 1990s, the Second District Council member has operated a field office at 2132 East Fourth Street (Site) to provide residents with a convenient point of contact to discuss community issues. The Site is a visible storefront office facility that is easily accessible to the public and has become a vital part of the neighborhood providing various services to Second District constituents.
 
The current Lease expired on August 31,2005 and the Second District Field Office has continued offering its services at the Site under a month-to-month tenancy arrangement with the Landlord. In an effort to secure the Site for continued long-term use, a new Lease has been negotiated with the Landlord containing the following major terms and conditions:
 
      > Landlord: Raquel Martinez.
 
      > Tenant: The City of Long Beach.
 
      > Leased Premises: Approximately 414 square feet of commercial office space
         located at 2132 East Fourth Street.
 
      > Term: Two-year term commencing on January 1, 2008, and terminating
         December 31 , 2009.
 
      > Rent: The monthly base rent shall be $925. On January 1, 2009, the monthly
         base rent shall increase to $971.25.
 
      > Utilities: The Landlord shall be responsible for all water, refuse collection and
         common area electrical charges. The Tenant shall be responsible for electrical
         and janitorial services to the Leased Premises.
 
      > Option to Renew: The City shall be provided with an option to renew the Lease
         for one additional two-year term conditioned on the mutual agreement by both
         Landlord and Tenant of the rent for the option period.
 
This letter was reviewed by Deputy City Attorney Richard F. Anthony on December 5, 2007 and Budget Management Officer Victoria Bell on December 6,2007.
 
TIMING CONSIDERATIONS
City Council action is requested on January 15, 2008 in order to formalize an agreement for the continued occupancy of the site.
 
FISCAL IMPACT
Annual base rent is estimated at $8,325 for FY 08. Sufficient funds are budgeted in the General Fund (GF) in the Legislative Department (LD) to support this activity.
