DISCUSSION
As part of the American Recovery and Reinvestment Act of 2009 (ARRA), certain funds were set aside for the rehabilitation of roads. Projects to be done under this program had to be ready to go to construction immediately, listed as a federal aide urban route (FAU) by the Federal Highway Administration, and listed in the State's Transportation Improvement Program. California Avenue between Harding Street and Artesia Boulevard fell within this category and was approved for funding under this ARRA program.
 
The anticipated rehabilitation work on California Avenue will consist of removing concrete and bituminous surfaces; constructing Portland cement concrete curbs, gutters and sidewalks;
doing all necessary excavation and grading; cold milling; constructing asphalt concrete pavement on aggregate base and resurfacing with rubberized asphalt pavement; and furnishing and installing pavement markers, markings and traffic stripping. A vicinity map of the area is attached as Exhibit A.
 
City Council's adoption of the plans and specifications and award of the contract to the lowest responsible bidder are being recommended concurrently in order to expedite implementation of this project. The project was advertised for bids on July 3, 2009, and bids were opened on August 20, 2009. Information regarding Nobest Incorporated is provided in the attached contract award document marked as Exhibit B.
 
This matter was reviewed by Deputy City Attorney Linda Trang on September 14, 2009, and by Budget and Performance Management Bureau Manager David Wodynski on September 21, 2009.
 
SUSTAINABILITY
 
The street will be resurfaced with asphalt containing up to 15 percent recycled material as well as recycled rubber from old tires. It is estimated that up to 1,388 tires will be recycled through the use of rubberized asphalt in this project.
 
TIMING CONSIDERATIONS
City Council action on this matter is requested on October 6, 2009, to authorize commencement of this Public Works project. Construction is projected to begin in January 2010, and should take approximately 50 working days.
 
FISCAL IMPACT
The contract award is for an estimated amount of $421,000 plus a 10 percent contingency of $42,100, if necessary and if funds are available, and a 15 percent estimate for construction support including such work activities as inspection, materials, testing and DBE and prevailing wage oversight, in the amount of $63,150. Since this federal stimulus grant funding is not yet appropriated, an appropriation increase of $526,250 is requested in the Gas Tax Street Improvement Fund (SR 181) in the Department of Public Works (PW).
