DISCUSSION
On August 24, 2004, the City Council authorized the execution of Site License No.
29003 for leased property for the location and installation of a flight tracking radar system for the Long Beach Airport (Airport). The system, also known as SkyTrak, captures accurate and consistent radar data and was part of an upgrade to the Airport Noise and Operations Monitoring System (ANOMS) to monitor compliance with the City's Noise Compatibility Ordinance.
 
SkyTrak, consisting of two antennae, a receiver and a processor, is installed and positioned in Garden Grove near an existing Federal Aviation Administration (FAA) radar facility to provide optimum data coverage in order to process and display an aircraft's operator, altitude, direction and air speed. Utilized by staff to track and investigate noise events at the Airport, SkyTrak is also made available on the Airport's website to allow residents to view real-time aircraft activity over their communities. In addition to viewing activity, residents can utilize SkyTrak to register complaints online.
 
The Site License terminated on March 6, 2010, and continues on a month-to-month basis. The First Amendment to Site License No. 29003 has been negotiated, containing the following major terms and provisions:
 
·      Licensor: Walton CWCA Garden Grove, LLC, a Delaware limited liability company, successor in interest to Cal West Industrial Properties, LLC, a California limited liability company.
 
·      Licensee: City of Long Beach.
 
·      Term: The term of the Site License shall be extended for a period of five years and 25 days and shall terminate on March 31, 2015.
 
·      Rent: The monthly base rent shall be $483.03 and shall increase 3% annually on April 1.
 
Under the terms of the Site License, the City may terminate the agreement, in the event the site is no longer suitable for its operations due to economic, environmental or technological reasons or problems with radar signal strength or interference. All remaining terms and provisions shall remain in full force and effect.
 
This letter was reviewed by Deputy City Attorney Richard F. Anthony on May 10, 2010, and Budget Management Officer Victoria Bell on May 17, 2010.
 
TIMING CONSIDERATIONS
City Council action is requested on June 15, 2010, in order to execute the First Amendment in a timely fashion for continued operation of the Airport's flight tracking radar system.
 
FISCAL IMPACT
Annual rental payments of $5,796 are budgeted in the Airport Enterprise Fund (EF 320) in the Airport Department (AP). There is no impact to the General Fund and no impact to local jobs.
