TITLE

Recommendation to adopt resolution authorizing City Manager, or designee, to execute an agreement, and all necessary documents including any amendments, with Downtown Long Beach Alliance, of Long Beach, CA, for enhanced services on First Street between Pacific Avenue and Long Beach Boulevard, and trash receptacles throughout the Downtown area, for a two-year term from January 1, 2021 through December 31, 2022, in an annual amount of $243,400 for calendar year 2021, and $252,000 for calendar year 2022.  (Districts 1,2)

 

DISCUSSION

City Council approval is requested to enter into an agreement with Downtown Long Beach Alliance (DLBA), for enhanced services on First Street between Pacific Avenue and Long Beach Boulevard, and trash receptacles throughout the Downtown area.

 

In 1998, the City Council established the Downtown Long Beach Property and Business Improvement District (DLBPBID) for an initial period of five years, and subsequently extended the DLBPBID for two ten-year periods, with the current term in effect through 2022. Under the approved Management Plan, DLBA is obligated to carry out certain upkeep operations in the Downtown area.

 

Since 2013, DLBA has provided additional and enhanced services in the First Street Transit Mall over and above those listed in the DLBPBID Management Plan and annual report and is reimbursed with Proposition A and Refuse/Recycling Funds.  These additional services have been exceptionally useful in maintaining a clean and safe Downtown area. This action will align the term of the requested agreement with the expiration and possible renewal of the DLBPBID.

 

On April 14, 2020, a Memorandum of Understanding (MOU) with the DLBA was authorized for enhanced services on First Street between Pacific Avenue and Long Beach Boulevard, and trash receptacles throughout the Downtown area. The current authorization for the MOU expires on December 31, 2020.  This action will align the term of the agreement with the expiration.

 

City Charter Section 1801 requires that contracts for City purchases be awarded to the lowest responsible bidder after a competitive bid process, but allows for awards without a competitive bid process if accompanied by a Resolution of the City Council. The DLBA has been providing service in the designated area for the DLBPBID pursuant to the terms of the Management Plan.  The additional maintenance service contemplated is interconnected to the services provided and expands on the upkeep operations the DLBA is already undertaking under the Management Plan.  This allows for a consistent maintenance approach of the Downtown area. Bidding this additional work would not be expected to result in costs savings to City and would, if awarded to a different vendor, require additional staff efforts to coordinate between multiple providers.

 

This matter was reviewed by Deputy City Attorney Erin Weesner-McKinley and Business Service Bureau Manager Tara Yeats on December 3, 2020 and by Budget Analysis Officer Julissa José-Murray on November 28, 2020.

 

TIMING CONSIDERATIONS

City Council Action is requested on January 5, 2021, to allow for uninterrupted continuation of services.

 

FISCAL IMPACT

This recommendation will continue the DLBA services through December 31, 2022 and authorize $243,000 in expenditures for 2021 and $252,000 for 2022 in the General Capital Projects Fund Group in the Public Works Department. This agreement is offset by Proposition A transportation funds of $177,400 for 2021 and $186,000 in 2022 and $66,000 annually from the Refuse/Recycling Fund Group in the Public Works Department. These amounts are appropriated in FY 21. This recommendation has no staffing impact beyond the normal budgeted scope of duties and is consistent with existing City Council priorities.  There is no local job impact associated with this recommendation.
