TITLE
Recommendation to authorize City Manager to execute a right-of-entry permit and any related documents with the Society for the Prevention of Cruelty to Animals Los Angeles for the installation of a pedestrian gate at, and the use of a portion of, the Department of Parks, Recreation and Marine maintenance yard, located in El Dorado Regional Park, Area I, to park and store various vehicles, for a term of three years, with one, three-year renewal option at the discretion of the City Manager or his designee.  (District 5)
 
DISCUSSION
Since 2001, the Society for the Prevention of Cruelty to Animals Los Angeles (SPCALA) has partnered with the City of Long Beach (City) to create and operate the P.O. Pitchford Companion Animal Village (Animal Village), a park-like animal care and adoption center serving Long Beach and the surrounding communities. The popularity of the Animal Village has grown over the years and attracts a large number of visitors each day. With the popularity of the Animal Village, the limited parking area cannot always accommodate all visitors. Several of the Animal Village parking spaces are used to store SPCALA disaster and shelter operations vehicles and trailers (Vehicles) that serve the shelter operations at the Animal Village, as well as community animal events, and emergency response and crime scene support related to animals.
 
The SPCALA has submitted a request to the Department of Parks, Recreation and Marine (PRM) to move several SPCALA-owned Vehicles from the Animal Village parking lot to a little-used corner of PRM's maintenance yard (Yard), which is located adjacent to the Animal Village (Attachment). The SPCALA would like to install a secured pedestrian gate in the Yard fence that separates the Yard from the Animal Village so that the SPCALA may access their Vehicles. Vehicles will use the main vehicle gate to enter and exit the Yard.
 
The proposed right-of-entry permit will contain the following major provisions:
 
• Term: Three years, February 1, 2014 through January 31, 2017.
 
• Renewal Option: One, three-year renewal option at the discretion of the. City Manager or his designee.
 
• Authorized Use: To install a pedestrian gate and to store SPCALA Vehicles in the Yard, which are necessary for the operation of the SPCALA, in partnership with the City.
 
• Permitted Area: An area in the southeast corner of the Yard, located in EI Dorado Regional Park, Area I, sufficient to hold SPCALA Vehicles, as approved by the City Manager or his designee. The SPCALA will install, at its own cost, a secured gate in the Yard fence to allow the SPCALA to access their Vehicles. The City will provide SPCALA with a separate vehicle gate code to allow the SPCALA to move their Vehicles in and out of the Yard, as needed.
 
• Fee: In recognition of SPCALA's partnership with the City through the P.D.  Pitchford Companion Animal Village, their contribution to the community, and the parking spaces that will be made available to visitors to the Animal Village through the relocation of the SPCALA vehicles, there will be no charge to the SPCALA for their use of the permitted area.
 
• Liability: The City shall not be liable for any damage or theft to SPCALA Vehicles while the Vehicles are being stored or used on City property. The SPCALA shall be responsible for any damage to the Yard caused by their use of the permitted area.
 
• Insurance: The SPCALA shall provide evidence of insurance as required by the City's Risk Manager.
 
This matter was reviewed by Deputy City Attorney Gary J. Anderson on January 9, 2014, and by Budget Management Officer Victoria Bell on December 23, 2013.
 
TIMING CONSIDERATIONS
City Council action is requested on January 21, 2014, in order to enable the execution of the right-of-entry permit and any related documents in a timely manner.
 
FISCAL IMPACT
There is no impact to any City fund associated with the recommended action. There is no impact to jobs associated with the recommended action.
