TITLE
Recommendation to authorize City Manager to execute the Third Amendment to Contract No. 29182 with TruGreen Landcare, a California General Partnership, extending the term to July 31, 2008, and increasing the contract amount by $200,000 to furnish and deliver tree-trimming services.  (Citywide)
 
DISCUSSION
On March 13, 2007, the City Council authorized the second amendment to the above referenced contract to extend the term and increase the contract amount to allow for the completion of scheduled tree trimming for the FY07 -08 fiscal year. Due to weather delays this winter, the tree contractor will not be able to complete all of the scheduled tree trimming by the expiration of the current contract on April 10, 2008. Based on the amount of trees remaining to be trimmed the contractor has estimated that the work can be completed by end of June, or early July. Staff is recommending that the contract term be extended until July 31, 2008 to insure the timely completion of the remaining trees to be trimmed this fiscal year.
 
This matter was reviewed by Deputy City Attorney Amy Burton on March 21, 2008 and by Budget Management Officer Victoria Bell on March 24, 2008.
 
TIMING CONSIDERATIONS
City Council action on this matter is requested on April 1, 2008 to ensure that the current contract is extended prior to the April 10, 2008 expiration date and that scheduled tree trimming for this fiscal year is completed in a timely manner.
 
FISCAL IMPACT
Funds for the tree trimming work are provided for in the Department of Public Works annual General Fund operating budget. No appropriation increase is required.
