DISCUSSION
The Public Works Fleet Service Bureau (Fleet) maintains and repairs the City's 15 fuel sites throughout the City in accordance with State regulations, a Stipulated Agreement with the Attorney General's office, and a comprehensive Underground Storage Tank Compliance program. Due to State regulations implemented on March 1, 2010, all repair services must now be performed by an International Code Council (ICC) certified technician. Fleet staff are not currently ICC certified, however, they are undergoing training for certification, and it is expected that at least one staff person will be certified within six months. Fleet has an existing contract with Fleming Environmental, Inc., for specialized repair and maintenance services, including underground storage tanks. Fleming's technicians are ICC certified, therefore, this company is certified to implement these repairs. Fleet is requesting an increase of $55,000 to the current Fleming contract amount of $95,000, for a total amount of $150,000, to accommodate the increased need for repair services for the remainder of the one-year contract term.

This matter was reviewed by Deputy City Attorney Gary J. Anderson on May 13, 2010 and by Budget Management Officer Victoria Bell on May 18, 2010

TIMING CONSIDERATIONS
City Council action on this matter is requested on June 15, 2010 to continue to meet all compliance regulations and continue to maintain fuel sites in a safe and efficient manner.

FISCAL IMPACT
The cost of this contract in the amount of $150,000, is budgeted in the Fleet Services Fund (IS 386) in the Department of Public Works (PW). Costs are recovered from the user departments through monthly Underground Storage Tank charges.
