DISCUSSION
On May 15, 2007, the City Council approved a professional services agreement with Martinez Architects, Inc., (MAl), for design and engineering services for the California Recreation Center Teen Center Project, with an option to renew for one additional year.
 
Construction .documents for the project are complete. Completion of the construction document phase of this project was delayed due to changes in the scope of work, as well as code changes that resulted in deleting the work to the existing building from the plan set. The project includes construction of a new teen center, an expansion to the park, a new courtyard, and a new parking lot. The project is complex and the existing bid package prepared by MAl is over 100 plan sheets in size and scope.
 
As the designer of record, MAl carries the professional liability insurance required for the design, plans, and specifications for the project. It is prudent to continue utilizing MAl's services for this project in order to continue liability protection for the City relative to possible errors and omissions in the construction documents. In addition, MAl's familiarity with the project will help to expedite the bidding and construction process. The remaining services include answering questions during the bidding process specific to the plans and specifications, responding to requests for information from the contractors, resolving plans conflicts in connection with unforeseen construction issues, and reviewing construction submittals. It is standard practice for the designer of record to complete these tasks to ensure that any liability associated with errors and omissions on the plans remains with the architect.
 
The bidding process for the project commenced in late April 2010. Completion of all work is expected by June 30, 2011. Therefore, a Second Amendment to Agreement No. 30219 with MAl will be required, at no additional cost, in order to extend the term of their agreement.
 
This matter was reviewed by Deputy City Attorney Gary J. Anderson on April 13, 2010, and Budget Management Officer Victoria Bell on April 15, 2010.
 
TIMING CONSIDERATIONS
City Council action is requested on May 4, 2010, in order to provide sufficient time to extend the agreement In addition, a portion of the project costs are funded by state grant funds that expire in June 2011. Continuing to utilize the services of MAl to complete this project will allow the City to avoid delays associated with securing the services of another architectural firm.
 
FISCAL IMPACT
The existing agreement with Martinez Architects, Inc., is for an amount not to exceed $470,000. Sufficient funds are budgeted in the Capital Project Fund (CP) in the Department of Public Works (PW). No additional funds are required for the Second Amendment, which will extend the term of Agreement No. 30219 to May 15, 2012. The recommended action will result in a positive impact on jobs, although the exact number is unknown. The extension of the term of this contract will result in continued work for staff employed by MAl, as well as a bidding and construction process, which will provide temporary construction and engineering jobs related to the project
