TITLE
Recommendation to authorize City Manager to execute an amendment to Contract No. 32533 with Moose Boats, Inc., of Petaluma, CA (not an MBE, WBE, SBE or Local), for the purchase of one 44-foot Tactical Emergency Response Vessel (TERV) and one 35-foot critical incident response/patrol boat and related equipment, increasing the amount by $68,930, bringing the total amount not to exceed $1,626,469, to reflect requested modifications to the boats.  (Citywide)
 
DISCUSSION
On January 17, 2012, the City Council granted approval to enter into a contract with Moose Boats, Inc., for the purchase of one TERV and one 35-foot critical incident response/patrol boat and related equipment for a total amount of $1,557,539. The purchase of these vessels will enable the Long Beach Police Department (LBPD) to gain heightened port and maritime emergency response capabilities and security. Both boats are currently under construction. Delivery of the TERV is expected in June 2013, and delivery of the critical incident response/patrol boat is anticipated in October 2013.
 
LBPD attended a mid-build conference with Moose Boats, Inc. During this meeting, both parties determined that the interior height of the 35-foot critical incident response/patrol boat was insufficient, as it confined the operating officer. Both the ceiling and floor heights will be modified to allow the officer to operate the vessel more efficiently. It was also determined that a protective barrier needed to be added to the front to provide extra protection to the exterior of the boat. These changes will increase the total cost of the contract by $68,930, which will be funded by the 2008 Port Security Grant Program.  The 2008 Port Security Grant Program is providing 75 percent of the funding for the vessels, and the required 25 percent match from the City is being provided by the Harbor Department through the California Port and Maritime Security Grant Program Prop 1B (CPMSGP).  Therefore, City Council approval is requested to authorize the City Manager to amend the contract to reflect requested modifications to the boat.
 
This matter was reviewed by Deputy City Attorney Gary J. Anderson on April 8, 2013 and Budget Management Officer Victoria Bell on April 5, 2013.
 
TIMING CONSIDERATIONS
City Council action to amend Contract No. 32533 is requested on April 23, 2013 to ensure that construction of the boats is uninterrupted and the equipment is purchased and installed in a timely manner.  
 
FISCAL IMPACT
The amended contract is for an amount not to exceed $1,626,469, with 75 percent of the cost currently budgeted in the General Grants Fund (SR 120) in the Police Department (PD).  The Port Security Grant Program 2008 requires a 25 percent match from the City, which will be provided by the Harbor Department through the CPMSGP Prop 1B Grant.  There is no local job impact associated with this recommendation.
