TITLE
Recommendation to authorize City Manager to execute all necessary documents to amend Contract No. 31822 with EFS West for design and construction of the Phase II portion of the Shoreline Marina Fuel Dock and Underground Storage Tank (UST) Improvement Project, increasing the contract price by $35,000. (District 2)
DISCUSSION
The City of Long Beach owns and operates three full-service marinas, including the Alamitos Bay Marina (Alamitos Bay), Long Beach Shoreline Marina (Shoreline Marina), and Rainbow Harbor/Rainbow Marina (Rainbow Marina), which are operated by the Parks, Recreation and Marine Department (PRM). In order to service these marinas, the City maintains two fueling docks, one in the Shoreline Marina and one in Alamitos Bay.
In September 2008, the Shoreline Marina fuel dock was closed because it did not meet current regulations. As a result, only the Alamitos Bay location is currently available for fueling needs. Recently, staff has been proceeding with a project to remove and replace the UST and restore this facility to full operation. On August 3, 2010, the City Council approved Contract No. 31822 with EFS West (Contractor) for Phase I of this project for the removal of the existing non-compliant UST.
The Contractor has completed the removal of the UST and has complied with all other environmental requirements related to UST removals in order to comply with the City's obligations and State regulations.
On May 17, 2011, the City Council authorized the design and construction of Phase II. Phase II portion of the contract includes the installation of the new UST and the physical construction of the new fuel site and necessary dock structures. During the ground excavation, the Contractor encountered unforeseen conditions, which prompted the City to take additional action to comply with regulatory requirements. Soil samples taken from the site revealed residual metal constituents, which require filtration or water treatment before discharge to the Shoreline Marina. Additional funding is necessary to allow for associated cost for the filtration and treatment to move forward with this project and meet the scheduled site re-open date of September 30, 2012.

SUSTAINABILITY
Keeping the Long Beach coastal assets and the public safe from the environmental hazards of operating fuel sites is of vital importance to the City. The City's adopted Underground Storage Tank Compliance Program has been designed to prevent harm to the environment from the City's fuel sites and underground storage tanks. With the availability of a local fueling site, less fuel will be utilized and fewer pollutants will be generated by the local boaters into the local environment.
TIMING CONSIDERATIONS
City Council action on this matter is requested on September 18, 2012 to authorize completion of Phase II construction of this project. Phase II is estimated to be completed within two weeks. In order to meet certain regulatory requirements, it is critical to complete this project by September 30, 2012.
FISCAL IMPACT
The Phase II construction portion of the contract increased by $35,000, for a total of $1,641,407. In addition, the project will incur costs for construction inspection, lab testing, and regulatory permit fees, which will increase the total estimated cost for Phase II to $1,877,384. During the course of construction, there will be up to 22 local people employed by this contract.
