DISCUSSION
On May 15, 2007, the City Council approved a professional services agreement with Martinez Architects, Inc., (MAl), for design and engineering services for the California Recreation Center Teen Center Project, with an option to renew for one additional year.
Construction .documents for the project are complete. Completion of the construction document phase of this project was delayed due to changes in the scope of work, as well as code changes that resulted in deleting the work to the existing building from the plan set. The project includes construction of a new teen center, an expansion to the park, a new courtyard, and a new parking lot. The project is complex and the existing bid package prepared by MAl is over 100 plan sheets in size and scope.
As the designer of record, MAl carries the professional liability insurance required for the design, plans, and specifications for the project. It is prudent to continue utilizing MAl's services for this project in order to continue liability protection for the City relative to possible errors and omissions in the construction documents. In addition, MAl's familiarity with the project will help to expedite the bidding and construction process. The remaining services include answering questions during the bidding process specific to the plans and specifications, responding to requests for information from the contractors, resolving plans conflicts in connection with unforeseen construction issues, and reviewing construction submittals. It is standard practice for the designer of record to complete these tasks to ensure that any liability associated with errors and omissions on the plans remains with the architect....
