TITLE
Recommendation to authorize City Manager to request reimbursement from the State of California, Department of Boating and Waterways, for the design and engineering of Basins 2 and 3 in the Alamitos Bay Marina.  (District 3)
 
DISCUSSION
In June 2003, the City Council authorized the City Manager to apply for loan funding from the State of California, Department of Boating and Waterways (DBW), to reconstruct Basins 2 and 3 in the Alamitos Bay Marina (ABM) as part of DBW's Public Marina Loan Program.  Between 2004 and 2007, DBW approved loans totaling $1,100,000 for the design and engineering of Basins 2 and 3.  
 
On December 20, 2005, the City Council authorized the execution of Contract No. 29587 with TranSystems Corporation (TranSystems) to provide engineering support and construction management for the ABM rebuild.  In October 2007, a design-build Request for Proposal for the rebuild of ABM was issued and later awarded to Bellingham Marine Industries, Inc. (BMI).  On February 16, 2010, the City Council authorized the execution of Contract No. 31687 with BMI.  The Department of Parks, Recreation and Marine (PRM), in conjunction with TranSystems and BMI, have been designing, engineering, and rebuilding ABM since 2007.  Included in this process is the concurrent design and engineering of Basins 1, 2, 3, 4, 5, 6, and 7.
 
DBW has reimbursed for design and engineering expenses for Basins 1 and 4 against contracts previously authorized by the City Council.  There are no approved DBW loans for Basins 5, 6 and 7.   DBW has indicated that reimbursement for expenses incurred against the DBW loans for Basins 2 and 3 shall be authorized upon City Council approval.  Therefore, PRM is seeking authorization to request reimbursement for the design and engineering of Basins 2 and 3.
 
This matter was reviewed by Deputy City Attorney Gary J. Anderson on August 6, 2012, and Budget Management Officer Victoria Bell on August 3, 2012.
 
TIMING CONSIDERATIONS
City Council action is requested on September 4, 2012, in order to facilitate the reimbursement of funds from the Department of Boating and Waterways.  
 
FISCAL IMPACT
This action will result in a $1,100,000 reimbursement to the Marina Fund (TF 403) in the Department of Parks, Recreation and Marine (PR). There is no impact to jobs associated with the recommended action.
