TITLE

Recommendation to authorize City Attorney to pay sum of $256,076.60, in full settlement of lawsuit entitled Lexington Insurance Company vs. City of Long Beach, Los Angeles Superior Court Case No. 22LBCV00536.

DISCUSSION

Plaintiff alleged that, as the result of a dispute regarding "defense costs," the City still owed Plaintiff a portion of the Self-Insured Retention for five lawsuits where Plaintiff had contributed toward settlement of those cases.

Following extensive negotiations, Plaintiff agreed to accept $256,076.60 inclusive of costs and fees - as a full settlement of this case.

The settlement was discussed in closed session, and approved, by the Government Operations and Efficiency Committee (Attorney/Client) on April  18, 2023.

SUGGESTED ACTION

Approve recommendation.
