TITLE

Recommendation to authorize City Manager, or designee, to process a refund totaling $13,711 to Mercy Housing California 95, L.P., for a project located at 941 East Pacific Coast Highway.  (District 6)

 

DISCUSSION

In accordance with the City’s Master Fees and Charges Schedule, applicants pay fees to the Development Services Department and place funds on deposit to pay for services and reimburse costs related to the preparation of environmental impact reports consistent with the requirements of the California Environmental Quality Act. In the event services are not provided, or the deposit exceeds the actual expenses and surcharges, a refund is processed. In this case, the applicant’s initial deposit has exceeded expenses by $13,711, and thereby, Mercy Housing California 95, L.P. is entitled to a refund.

 

Approval to issue the refund is requested on behalf of the applicant.  Long Beach Municipal Code Section 3.48.040 requires refunds exceeding $10,000 to be approved by the City Attorney and City Council.

 

This matter was reviewed by Assistant City Attorney Dawn A. McIntosh on May 3, 2022 and by Revenue Management Officer Geraldine Alejo on May 17, 2022.

 

TIMING CONSIDERATIONS

City Council action is requested on June 14, 2022, to expedite processing the refund.

 

FISCAL IMPACT

The approval of this recommendation will result in a refund totaling $13,711 from the Development Services Fund Group in the Development Services Department. This recommendation has no staffing impact beyond the budgeted scope of duties and is consistent with existing City Council priorities. There is no local job impact associated with this recommendation.
