TITLE

Recommendation to authorize the Development Services Department to process a refund in the amount of $19,893 to Urban Pacifica Development Group, LLC, for a project located at 1901 Pacific Avenue.  (District 6)

 

DISCUSSION

On August 24, 2020, Urban Pacifica Development Group, LLC, paid fees to the City of Long Beach (City), which were deposited in the Development Services Fund Group in the Development Services Department, for plan check services and surcharges related to the preparation of an entitlement application for a Site Plan Review and a Zone Change at 1901 Pacific Avenue. However, the applicant is not moving forward with the project and is eligible for a refund of $19,893.

 

In accordance with Long Beach Municipal Code Section 3.48.040, refunds exceeding $10,000 must be approved by the City Attorney and the City Council. Authorization to process the refund is requested on behalf of the applicant.

 

This matter was reviewed by Assistant City Attorney Michael J. Mais and Budget Operations and Development Officer Rhutu Amin Gharib October 7, 2021.

 

TIMING CONSIDERATIONS

City Council action is requested on November 16, 2021, to expedite processing of the refund.

 

FISCAL IMPACT

The approval of this recommendation will result in a refund of fees totaling $19,893 from the Development Services Fund Group in the Development Services Department. The requested action has no staffing impacts beyond the normal budgeted scope of duties and is consistent with existing City Council priorities. There is no local job impact associated with this recommendation.
