TITLE

Recommendation to authorize City Manager, or designee, to accept a quitclaim deed from McDonnell Douglas Corporation, now known as The Boeing Company, to terminate a utility easement at 4100 Donald Douglas Drive.  (District 5)

 

DISCUSSION

On January 23,1990, McDonnell Douglas Corporation, a Maryland corporation, was granted an exclusive permanent easement per recorded document 90413957 on DEED 7553, under supplement S-12-02 for Franchise Permit No. P-82-58, to use, install, maintain, operate, alter, add to, repair, replace, and/or remove plastic communication conduit systems for the transmission of telecommunication signals and other purposes located at 4100 Donald Douglas Drive.

 

McDonnell Douglas Corporation, now known as The Boeing Company, no longer requires use of the easement.  Accepting the quitclaim removes the encumbrance from airport property. Additionally, terminating the easement makes the existing conduit systems available for future City uses. The necessary City departments and Public Works have reviewed the proposed quitclaim deed and termination and have no objections to accepting the deed.  This action is exempt from CEQA.

 

This matter was reviewed by Deputy City Attorney Erin Weesner-McKinley on June 24, 2021 and by Budget Management Officer Rhutu Amin Gharib on June 23, 2021.

 

TIMING CONSIDERATIONS

City Council action on this matter is not time critical.

 

FISCAL IMPACT

A quitclaim processing fee in the amount of $ 3,313 was deposited in the General Fund Group in the Public Works Department in FY 21. This recommendation has no staffing impact beyond the normal budgeted scope of duties and is consistent with existing City Council priorities.  There is no local job impact associated with this recommendation.
